A federal judge on October 30 denied X.AI Corp. and MZX Tech LLC’s motion to dismiss an NAACP lawsuit over Southaven, Mississippi, turbines.

## The big change

- The judge rejected a mobile-source permit exemption argument.
- The court upheld the organizations’ statutory standing.
- The decision is not a liability verdict.

## What the court decided

The NAACP and its Mississippi State Conference allege in their [complaint](https://naacp.org/sites/default/files/documents/1%20-%20Complaint.pdf) that the companies built and operated the Colossus Gas Plant without required permits. The defendants cited a state agency letter and argued the portable turbines were exempt as mobile sources.

In the [order](https://earthjustice.org/wp-content/uploads/2026/10/10313375508_6407.pdf), U.S. District Judge Debra M. Brown applied federal definitions incorporated into Mississippi’s plan. Accepting pleaded facts for this motion, she concluded the turbines were not mobile sources and found statutory standing. The court noted that portability did not make them self-propelled while operating.

The complaint says a different plant’s permit did not cover these turbines; this dismissal ruling neither decides liability nor imposes a remedy.

## Why permits matter

The [Environmental Protection Agency](https://www.epa.gov/nsr/new-source-review-basics) describes Prevention of Significant Deterioration as preconstruction permitting for qualifying major sources in areas meeting applicable air standards. Permits can specify allowed construction, emission limits and operating conditions.
